Jenna Sue Design Advisor

These Terms of Service (“Terms”) govern your access to and use of the Jenna Sue Design Advisor (the “Advisor”), an AI-powered interior design chat tool offered by JennaSue Design LLC (“JennaSue Design,” “we,” “us,” or “our”). Please read these Terms carefully. By creating an account, accessing, or using the Advisor, you agree to be bound by these Terms. If you do not agree, do not use the Advisor.
Your use of the Advisor is also governed by our Privacy Policy, which describes how we collect and use your information.
1. Who Can Use the Advisor
You must be at least 18 years old, or the age of majority where you live, to create an account or purchase a subscription. By using the Advisor, you represent that you meet this requirement and that the information you provide to us is accurate.
2. The Advisor Is Design Inspiration, Not Professional Advice
This is the most important thing to understand about the Advisor.
The Advisor is an artificial intelligence tool that generates interior design suggestions, product recommendations, and related ideas in the style of Jenna Sue Design. It is intended for general inspiration and informational purposes only.
You acknowledge and agree that:
- The Advisor is not a licensed interior designer, architect, engineer, or contractor, and its responses are not professional design, architectural, engineering, structural, electrical, or construction advice.
- The Advisor is AI-generated and may be inaccurate, incomplete, or unsuitable for your specific space, needs, or circumstances. It may occasionally produce information that is wrong or that does not reflect Jenna Sue Design’s actual views.
- You are responsible for independently verifying any information before relying on it — including product details, prices, availability, measurements, dimensions, materials, and suitability for your space.
- For any decision involving structural changes, electrical or plumbing work, permits, safety, or significant expense, you should consult an appropriately licensed professional. Do not rely on the Advisor for such decisions.
- Product prices, availability, and details change constantly and are controlled by third-party retailers, not by us. Any price or product information the Advisor provides may be out of date or incorrect at the time you act on it.
Any reliance you place on the Advisor’s output is at your own risk.
3. Accounts
To use the Advisor, you provide an email address. You are responsible for the activity that occurs under your account and for keeping your access credentials reasonably secure. You agree to provide accurate information and to notify us of any unauthorized use of your account. We may suspend or terminate accounts that violate these Terms.
4. Free Trial
We may offer a limited free trial that lets you exchange a set number of messages with the Advisor before subscribing. No payment information is required for the free trial. The trial is provided “as is,” and we may change or discontinue the trial, or the number of trial messages, at any time. Once your trial is used up, continued access requires a paid subscription.
5. Subscriptions, Billing, and Cancellation
Plans and pricing. Access to the full Advisor requires a paid subscription. We may offer monthly and annual subscription options. Current plans and prices will be displayed at the point of purchase. We may change our prices going forward; any price change will not affect the subscription period you have already paid for.
Billing. Payments are processed by our third-party payment processor, Stripe. By subscribing, you authorize us, through Stripe, to charge your payment method the applicable subscription fee.
Automatic renewal. Subscriptions automatically renew at the end of each billing period (monthly or annual, depending on your plan) at the then-current price, unless you cancel before the renewal date. By subscribing, you authorize these recurring charges until you cancel.
Cancellation. You may cancel your subscription at any time through your account settings or by contacting us at privacy@jennasuedesign.com. When you cancel, your subscription remains active through the end of the period you have already paid for, and it will not renew after that.
No refunds. Except where required by law, all payments are non-refundable. Canceling stops future charges but does not entitle you to a refund for the current or any prior billing period, including any unused portion of a subscription period.
6. Acceptable Use
When using the Advisor, you agree not to:
- Use it for any unlawful purpose or in violation of these Terms
- Upload content you do not have the right to share, or that infringes anyone’s rights
- Upload content that is harmful, abusive, harassing, obscene, or otherwise objectionable
- Attempt to reverse engineer, copy, scrape, or extract the underlying system, prompts, or models behind the Advisor
- Use the Advisor to build or train a competing product or service
- Resell, redistribute, or commercially exploit the Advisor or its output without our written permission
- Interfere with, disrupt, or attempt to gain unauthorized access to the Advisor, its servers, or related systems
- Use automated means to access the Advisor in a way that places unreasonable load on our systems
We may suspend or terminate your access if you violate these rules.
7. Your Content
The Advisor lets you submit messages and upload photos (“Your Content”). You retain ownership of Your Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process Your Content as needed to operate and improve the Advisor, as described in our Privacy Policy. You represent that you have the rights necessary to submit Your Content and that it does not violate these Terms or any law.
8. Our Content and Intellectual Property
The Advisor, including its design, text, the Jenna Sue Design name and brand, and the underlying software and system, is owned by JennaSue Design LLC or its licensors and is protected by intellectual property laws. These Terms do not grant you any ownership of the Advisor. You may use the Advisor’s output for your own personal, non-commercial home design purposes. You may not represent the Advisor’s output as the personal professional advice of Jenna LeBlanc or Jenna Sue Design.
9. The Advisor Is Not Jenna LeBlanc
The Advisor is an AI tool trained on Jenna Sue Design’s published work and design philosophy. It speaks in Jenna’s style, but it is not Jenna LeBlanc and does not represent her personal, individualized advice or her real-time involvement. Communicating with the Advisor does not create a designer-client relationship with Jenna LeBlanc or Jenna Sue Design.
10. Affiliate Links
The Advisor may recommend products and provide links to third-party retailers. Some of these are affiliate links, meaning we may earn a commission if you make a purchase through them, at no additional cost to you. We do not control third-party retailers, their products, prices, availability, or websites, and we are not responsible for your transactions with them.
11. Third-Party Services
The Advisor relies on third-party services, including the AI provider that generates responses, our hosting provider, our payment processor, and product and affiliate networks. Your use of the Advisor may be subject to those third parties’ own terms, and we are not responsible for their acts or omissions.
12. Disclaimer of Warranties
THE ADVISOR IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE ADVISOR WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ITS OUTPUT WILL BE ACCURATE, RELIABLE, OR SUITABLE FOR YOUR NEEDS. YOUR USE OF THE ADVISOR IS AT YOUR SOLE RISK.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JENNASUE DESIGN LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE ADVISOR, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE ADVISOR OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability or exclusions of warranties, so some of the above may not apply to you. In that case, our liability is limited to the fullest extent permitted by law.
14. Indemnification
You agree to indemnify and hold harmless JennaSue Design LLC and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Advisor, Your Content, or your violation of these Terms or any law or third-party right.
15. Changes to the Advisor and These Terms
We may modify, suspend, or discontinue the Advisor (or any part of it) at any time. We may also update these Terms from time to time. When we make material changes, we will update the “Effective date” above and post the revised Terms. Your continued use of the Advisor after changes take effect means you accept the updated Terms.
16. Termination
You may stop using the Advisor at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Advisor. Upon termination, the provisions of these Terms that by their nature should survive — including the disclaimers, limitation of liability, indemnification, and intellectual property provisions — will continue to apply.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Advisor will be brought exclusively in the state or federal courts located in Hillsborough County, Florida, and you consent to the personal jurisdiction of those courts.
18. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of it. These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Advisor.
